These Terms and Conditions ("Terms") govern your use of the Clearpoint Aerial LLC website and the services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully before proceeding.
Services Provided
Clearpoint Aerial LLC provides commercial drone services including but not limited to:
- Construction progress documentation (commercial and residential)
- Real estate aerial photography and video
- Aerial marketing photography and video for events, businesses, and brands
All services are subject to a separate written service agreement which will be provided prior to the commencement of any work. The specific scope, pricing, and deliverables for each engagement are defined in that agreement.
FAA Compliance & Licensing
All drone operations conducted by Clearpoint Aerial LLC are performed in compliance with FAA regulations under Part 107 Remote Pilot certification. We conduct pre-flight airspace evaluations and operational risk assessments before every flight. It is the client's responsibility to ensure that Clearpoint Aerial has access to the property or site for which services have been contracted.
Payment Terms
Payment terms are specified in the service agreement provided to each client. For recurring construction documentation services, billing is monthly as outlined in the applicable plan. For one-time services such as real estate photography, payment terms will be outlined in the service agreement prior to the shoot.
- All construction documentation plans require a 3-month minimum commitment
- After the minimum period, plans convert to month-to-month with 30 days written notice to cancel
- One-time service fees are due as outlined in the service agreement
- Late payments may result in suspension of services
Weather & Rescheduling
Drone operations are weather dependent. If conditions are deemed unsafe or unsuitable for flying — including but not limited to high winds, rain, fog, or low visibility — Clearpoint Aerial reserves the right to reschedule the affected visit at no additional charge to the client. We will communicate any weather-related delays as early as possible and prioritize rescheduling within the same billing period where feasible.
Intellectual Property & Ownership
All deliverables produced by Clearpoint Aerial — including aerial photographs, video footage, and edited files — are owned by the client upon full payment of the applicable service fee. No licensing fees or usage restrictions apply to delivered content unless otherwise specified in the service agreement.
Clearpoint Aerial retains the right to use project footage for portfolio, marketing, and promotional purposes unless the client requests otherwise in writing prior to the commencement of services.
Client Responsibilities
The client agrees to:
- Provide accurate project information including location, site access, and any relevant safety considerations
- Ensure site access is available at the scheduled time of service
- Notify Clearpoint Aerial of any known airspace restrictions, utility lines, or site hazards
- Obtain any necessary property owner permissions for drone operations over privately owned land
Limitation of Liability
Clearpoint Aerial LLC carries commercial drone liability insurance on all operations. To the fullest extent permitted by law, Clearpoint Aerial's liability for any claim arising from services provided shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
Clearpoint Aerial is not liable for delays, data loss, or service interruptions caused by weather, airspace restrictions, third-party platform outages (including Google Drive), or circumstances beyond our reasonable control.
Cancellation Policy
For recurring construction documentation services, either party may terminate the agreement with 30 days written notice after the initial minimum commitment period. For one-time services, cancellation terms are outlined in the individual service agreement. Cancellations made less than 48 hours before a scheduled shoot may be subject to a cancellation fee as specified in the service agreement.
Website Use
By using the Clearpoint Aerial website, you agree not to use the site for any unlawful purpose or in any way that could damage, disable, or impair the site. All content on this website — including text, images, and branding — is the property of Clearpoint Aerial LLC and may not be reproduced without written permission.
Governing Law
These Terms and Conditions are governed by the laws of the State of North Carolina. Any disputes arising from these Terms or from services provided by Clearpoint Aerial LLC shall be resolved in the appropriate courts of Iredell County, North Carolina.
Changes to These Terms
Clearpoint Aerial reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
