Services

Clearpoint Aerial LLC provides aerial photographic and video documentation services. The specific services, schedule, deliverables and price for any engagement are set out in a written service agreement between Clearpoint Aerial LLC and the client.

Scope of service

Clearpoint Aerial provides visual documentation services only. Deliverables are photographic and video records of site conditions visible on the date of capture. They are not land surveys, engineering assessments, or home inspections, and are not a substitute for the services of a licensed surveyor, engineer, or inspector.

Term and cancellation

Recurring documentation plans carry a three-month minimum and continue month to month after that. Either party may end a month-to-month agreement with 30 days written notice. Fees for visits already completed are not refundable.

Scheduling and weather

Drone operations are weather and airspace dependent. Where conditions are unsafe or a required authorization has not been granted, a scheduled visit is rescheduled at no additional charge. Clearpoint is not liable for delays caused by weather, airspace restrictions, or site conditions outside its control.

Site access and safety

The client is responsible for lawful access to the site and for notifying Clearpoint of hazards, restricted areas and any site-specific safety requirements. Clearpoint operates under FAA Part 107 and will not fly an operation it judges unsafe or non-compliant.

Ownership and license

On payment, all photographs and video captured for the client are owned by the client outright, with no watermark, licensing fee or usage restriction. Clearpoint retains the right to use imagery in its own portfolio only with the client's written permission.

File retention

Files delivered to the client are the client's property and the client may retain them indefinitely. Separately, Clearpoint retains its own indexed archive of original files for the duration of the agreement plus twelve months, and for ten years in the case of Build Record Plus and dry-in envelope flights, and will supply a file from that archive on request by capture date. After the applicable retention period the archive copy is deleted unless the client requests otherwise in writing. Deletion of the archive copy does not affect files already delivered to the client.

Insurance

Clearpoint Aerial LLC binds $1M aviation liability coverage for every flight it performs. A certificate of insurance naming the client as additional insured is issued before the first flight at no cost, and reissued on request at any point during the engagement.

Payment

Recurring plans are invoiced monthly in advance. Single-visit services are invoiced on delivery unless agreed otherwise. Accounts more than 30 days overdue may have service suspended until the balance is settled.

Limitation of liability

Clearpoint's total liability arising from any engagement is limited to the fees paid by the client for that engagement. Clearpoint is not liable for indirect or consequential losses, including losses arising from a client's reliance on imagery for a purpose requiring a licensed professional.

Trial flight and credit

A single Dry-In Envelope Flight may be booked without a recurring plan at the price posted at the time of booking. The images from that flight are delivered to the client and are the client's to keep, and the flight carries no obligation to continue. If the client begins a recurring documentation plan within thirty days of that flight, the amount paid for it is credited against the first month of the plan. The credit applies once per client, is not transferable, and is not redeemable for cash or refundable if no plan begins.

Delivery

Standard delivery is three business days from the date of the flight, not from the date originally scheduled, and two business days on the Continuous commercial plan. Where a visit is rescheduled for weather, airspace or site conditions, the delivery window runs from the rescheduled flight.

Changes to these terms

These terms may be updated. The version posted on this page at the time an engagement begins is the version that governs that engagement, and a signed service agreement takes precedence where the two differ.

Governing law

These terms are governed by the laws of the State of North Carolina.
